The Annual Tree Trimming Project is well underway as Frames Tree Service is continuing thinning and trimming the trees in the community. Today, they will be finishing trimming all of the trees in Patio Villas and another crew is currently working in the Condominiums. During the process, the tree trimmers first trim palms that they are able to climb, then thin the trees that are easily reachable and finish using the cherry picker to shape, thin and trim large trees and palms. If you think that the trimmers have missed trimming a tree or have any questions, please contact the office and we will check it out. Frames will be trimming around the Clubhouse and Pool Area, as well as removing stumps towards the end of the project, which should be completed by April 1st.

Felix & Associates, the contractor for the City of Boynton Beach installed new sod and Bahia grass yesterday, as part of the agreement to renovate the area that was used as an easement and staging area for the installation of the new water line on Boynton Beach Blvd. The area should actually look better than it did before the project, once the new sod gets established.

Mike Farrell, our contracted irrigation specialist, spent Thursday, Friday and part of last weekend extending irrigation lines and sprinklers, in order to make sure the new sod would get plenty of water. Mike, as usual, worked diligently to complete the work in a timely matter and we are very lucky to have Mike as our irrigation specialist. In addition, Mike Farrell is looking into possible remedies to improve the water level at the lake by the Cabana Club. Management will report back to the Board of any possible options.

Last week, Epic Wireless Corporation installed the latest software for all of our security cameras last week, both in the Clubhouse, as well as the Boynton Beach Blvd and Military Trail entrances. The new software enables motion sensor capabilities for the cameras, which will make it easier to review any incidents that occur at those locations.

Carrier Corporation Services replaced a thermostat and a duct detection sensor for the air conditioning system in the Center. The cost of the diagnosing the problem and the new parts including installation totaled $1,450.

Trugreen Landcare, is continuing to thin and cut back overgrown areca palms in the community. Trugreen has completed their work in Patio Villas and will finish up on 53rd Way in Clearbrook Village . The cost of this additional project is $2,600.50.

The POA recently purchased two new stereo receivers, with satellite radio and other capabilities at a cost of $738.62. We replaced the receiver at the Cabana Club, which was broken and also replaced the one at the Clubhouse, keeping the old receiver as a backup.

The 2010 Banyan Springs POA audit by Lamn, Krielow, Dytrych & Company, the Association’s Certified Public Accountants, has finished collecting all of the financial information needed and is in the process of completing the 2010 Financial Statements. Once a draft is received by the Board and approved, the Financial Statements will be available at the office for any interested unit owner. We will be posting notices around the Clubhouse and on Channel 63, when they are available.

In early January, the POA finally received a check for an insurance claim for an incident that occurred on June 28, 2010, which damaged an electrical box and the fence across from Ashley Lakes Apartments. The check for $1,256 covers the damages that were repaired over the summer. We are currently waiting on another check from the insurance company of a resident that did extensive damage to the fence and ficus hedges along Cedar Point Blvd behind Terrace Homes #I Condominium on December 31, 2010. Damages totaled $4,060 and we fully anticipate receiving full reimbursement for this incident.

Atlantic Refrigeration installed a new air handler for the Spa Area, where the Japanese Hot Tubs, Sauna and Steam Room are located on Wednesday, January 12, 2011 at a cost of $3,763.

The contractor for the installation of the water line for Boynton Beach Utilities, Felix & Associates, is finishing up work on the water pipe line project for the City of Boynton Beach . After the construction is complete, the City of Boynton Beach will restore the area that the City paid $20,000 to Banyan Springs for the Easement during the project.

Al Hoffer’s Pest Protection Services was in the community in Mid-January to fertilize the lawns and shrubs throughout Banyan Springs, as part of the Association’s Contract of services.

On Monday, January 17th, Rapid Rooter took a video of a drainage pipe at 10156 Mangrove Drive and discovered that a large section of the main drainage pipe was broken in a couple of sections with roots impeding the flow of waste water. Since the problem is located on common property, Rapid Rooter was contracted to excavate, remove the roots and replace 3 sections of drainage pipe. The entire cost of the project totaled $6,790.55 and was completed on Tuesday, January 18th.

Fineline Electric Inc., was here last week to run new wiring for electrical outlets in the Banyan Room to solve the problem of the coffee makers tripping the breakers during events in that room. The outlets that are normally used for this purpose are now isolated, which should solve the problem and the cost of the improvement totaled $1,011.78

The Banyan Springs Social Club has made a $700 Donation to the POA for purchase of ice buckets to be used by the various clubs for functions at the Center. The Board thanks the Social Club for their generosity.

Executive members of the POA Board met with Don Brady of R.V. Johnson Insurance Agency on Monday, January 31st, to go over the new insurance policies for 2011 for the POA. We anticipate the POA insurance policies to come in within the Budget for 2011. On Tuesday February 8th Don Brady will be meeting with Condominium Board Members to go over Property Insurance for the each Association in the Banyan Room at 2:00 P.M.

Air Ref Electric, was here yesterday to install the lighting that was approved by the Board at the December 30th Workshop Meeting for highlighting the “Bird Tree” sculpture in the Center. The entire project including wiring, fixtures and installation totaled $4,900.00 and will be completed today.

Our staff is currently working on cosmetic improvements to the men’s restroom in the Cabana Clubhouse. The staff will be working on the women’s restroom next week and hope to have everything completed by the end of next week.

A number of our residents have experienced problems entering the community at either of the resident gates, which means that your bar code sticker needs to be replaced with a new one. You can stop by the office during business hours and we will remove the old sticker and put a new one on your vehicle.

This month’s POA General Meeting is scheduled for Wednesday, February 16, 2011 at 7:30 P.M., in the Center. All residents are invited to attend.

Reading of the Minutes – Tony Scorsese

Larry Granet interrupted the reading of the minutes to make a motion regarding Florida Statute, 720.203 (10), which states that any parcel owner may tape record or video tape meetings of the Board. The Board may adopt reasonable rules governing the taping of meetings of the Board and the Membership. To address this issue, Mr. Granet made a motion that the Board adopts rules regarding video taping meetings in order to avoid any distractions or disruption of the meetings. The motion was made that “all taping and or recording of P.O.A. meetings be done from the rear of the room”.

Joel Brusso asked that the motion be amended, requesting that the word “video” be added to the recording. This amendment was accepted and seconded. The motion was adopted.

Reading of the minutes was then continued. There was a correction sited by Rick Leach with regard to the second bullet of the Managements update on page two where “public works dept.” was corrected to read: “contractor for the city”. Also corrected was the third bullet of Managements update on page two where the words “and election” was inserted after “Annual Meeting”.

Harry Sassower made a motion to accept the minutes of the December 30, 2010 Workshop Meeting as corrected. Seconded by Tony Scorsese and passed unanimously.

The Treasurer’s report showed a balance on hand as of 2/3/2011 of $348,291.49.

Highlights:

Barry Prince mentioned that the there was a copy of the contract on the new Café for the Board members in the office for their review and comment. He also mentioned that working drawings for the new Spa Area have gone out to two general contractors. Another one is to go out within the next two to three weeks and hopefully to award a contract out and commence work by July 4th and completed by Labor Day. The Fitness Center would have to be emptied and possibly move some of the exercise equipment over to the Cabana where it is hoped that Fahad could go there until the new Spa Area is ready.

A letter was presented to the Board by Miriam Plonsky saying that she was proud to have worked with the Board as Secretary and felt that they had many accomplishments for the benefit of the community.

There was a correction sited by Tony Scorsese on page 1 of the Management Update, paragraph 5. The location on Mangrove Drive was corrected from 10156 to 10174.

Larry Granet mentioned the poor lighting at the entrance to Military Trail and Rick Leach said they are looking into this but are holding off on it until the City restores that area.

Doug Weaving complained about the dumping of tree and shrub cuttings creating an eyesore and requested that this practice stop. Rick Leach said it was the first time he had heard of this complaint and would look into the matter.

Phil Rogers asked about the fixing up of the men’s room and the door to the men’s room in the Cabana and was assured by Barry Prince that this work will be done as it is on the work list.

Joel Brusso made a motion that for the annual audit we should hire the same auditors as last year, that being LDK. Seconded by Paul Whitney. There were no objections and the motion passed unanimously.

There were several owners complaining about a sign placed in the men’s locker room which states that men must wear a shirt when walking from the locker room through the fitness center into the Spa Area. Barry Prince sited the rules that “top coverings must be worn anywhere outside of the pool area”.

Various other questions were discussed at length.

Architectural requests

Robert Dow asked if there were any Architectural requests for work being done by the 2nd house on Rosehill Drive where there is a large dumpster. No one was aware of any such request and it was stated that it would be looked into.

Management Update

On December 31, 2010, in the wee hours of the morning, a resident of Ashley Reserve Apartments hit and did extensive damage to the fence and ficus hedges along Cedar Point Blvd behind Terrace Homes I Condominium. Fortunately, Palm Beach County Sheriffs Office responded to the accident, so we were able to obtain an accident report and have filed a claim with the driver’s insurance company. Meanwhile, Thompson Fencing Company replaced Fencing & Tree Trimming repaired the damaged fence and posts at a cost of $2,450 and Domenico’s Nursery & Landscaping replaced the damaged ficus at $1,610. We are currently awaiting a check from the insurance on this claim.

The decision was made to go ahead and replace the unit and the installation was completed on Wednesday, January 12, 2011 at a cost of $3,763.

The contractor for the installation of the water line for Boynton Beach Utilities, Felix & Associates, completed the work on installing the water pipe line at the front entrance to Banyan Springs. The work was completed on Thursday, January 13th without any major incident or accidents. Currently, the contractor is working on Boynton Beach Blvd progressing towards Military Trail and will finish up at the corner. The project should be completed by the first week in February. After the construction is complete, the City of Boynton Beach will restore the area.

Drainage problems over the weekend at 10174 Mangrove Drive , Lakeside Condominium #5, led to an emergency call to a local plumbing company this past weekend. When the plumber was fixing the problem, it was discovered that tree roots underground were causing the problem. On Monday, January 17th, Rapid Rooter put a camera in the pipe and it was discovered that a section of the main drainage pipe was broken in a couple of sections with roots impeding the flow of waste and located on common property, which is the responsibility of the POA. On Tuesday, Rapid Rooter was contracted to excavate, remove the roots and replace 3 sections of drainage pipe. The entire cost of this emergency project totaled $6,790.55 and was completed yesterday afternoon.Tem Systems was in the community yesterday afternoon to check an intermittent problem with the speaker on the call box at our main entrance. Adjustments were made to the system and resolved at no cost to the Association.

Management would like to remind all of our residents that if you experience any problems when entering the community at the either of the resident gates, you may have a bar code sticker that is weathered and needs to be replaced. If you or someone you know has had this problem, please come by the office and we will remove the old sticker and put a new one on your vehicle.

The Organizational Meeting for the 2011 Banyan Springs POA Board of Directors is scheduled for 10:00AM tomorrow morning in the Banyan Room. The meeting is for the Board to elect the officers for their new term.

· Barry Prince reported on the expiration of the services of Christopher La Dagana, Owner of the Poolside Café. Barry Prince said that we offered the sum of $10,000.00 to Christopher La Dagana for the equipment and supplies that he had in our café. He accepted the offer and turned his and all other keys over to Barry Prince. Christopher La Dagana then executed a letter of retirement from Banyan Springs, which was drawn up by our attorney.

· Barry Prince then spoke of our new Owner/Operator of the Café, his name is Abe Salama who will be running the operation with his son, David Salama. Abe Salama named the Café “ Norman ’s Café” in memory of his friend Norman Lubow, who was instrumental in acquiring Abe Salama for our premises.

· Abe Salama is the owner of the Essex Deli in Lake Worth also.

· Barry Prince then introduced Abe Salama, who assured us that he will run a clean and efficient café for our enjoyment. He said that he has a suggestion box for our use, and will consider and appreciate suggestions and/or comments from us.

Domenico’s Nursery and Landscaping completed the scheduled landscape improvements to various areas in the community on November 22nd. In addition to removing the old flowers and planting impatiens, Domenico’s installed sod and planted new shrubs where needed at many locations. The total cost of the project was $10,851.25, which was approved by the Landscaping Committee.

Al Hoffer Pest Protection Services has been in the community the last two weeks applying a light fertilization to maintain the lawns and treating the area for insects and weeds.

Boucher’s Gas Service replaced one of the natural gas pool heaters for the main pool on Wednesday, December 7th. The cost of the new heater totaled $3,301.50 including installation and removal of the old heater. The old heater could have been repaired, but the parts needed would have taken a couple of weeks to come in from California , so the decision was made to replace it immediately, especially as we are in season. Boucher’s has agreed to repair the old heater for an additional cost of $300, in order that we have a spare.

Sullivan Electric & Pump, Inc. had to replace the 10 HP pump, couplings, check valve and submersible cable at the Lake Well Pump behind Lakeside Condo 9.
Although the motor on the pump was in good condition, a number of components and pipe fittings had to be replaced. The work was completed last week and the cost totaled $5,291.53, including parts and labor.

Work is continuing on the upgrade of the Cabana Clubhouse. Our staff will be working on the walls in the hallway and the restrooms, which will complete the project. Also, our staff has been busy with the walls of the Clubhouse and yesterday assisted the Decorating Committee with hanging pictures.

We have received word from Andrew Culpepper of Felix & Associates, the contractor for the installation of the water line for Boynton Beach Utilities, regarding the dates that the water line will be installed along Boynton Beach Blvd at the main entrance to Banyan Springs at Cedar Point Blvd. The work is tentatively scheduled to begin on Wednesday, January 5, 2011 at 7:00 P.M until 6:00 A.M. as the entrance will be closed for work. On Thursday, January 6th, the exit on Cedar Point Blvd. will be closed and the entrance to the community will be open. During this period, the main entrance will be used to enter the community and all residents must exit the community through the Military Trail Exit. Although this will be an inconvenience, it will be a safer way for traffic to navigate through the community between the hours of 7:00 P.M. and 6:00 A.M. for the days that the work will be done. There will be an officer on duty to direct traffic to avoid potential confusion. As the start date is tentative and there is a possibility that the contractor may need another night, if there are any complications with the project, we will keep the community up to date if there are any changes to the schedule.

This week, the POA mailed the Second Notice of the 2011 Annual Meeting and Election to all 658 Unit Owners. The Annual Meeting and Election is scheduled on Wednesday, January 19, 2011 at 9:00 A.M. and 7:30 P.M. in the Center. There are ten Candidates vying for five vacancies and of course, they will be participating in tonight’s “Meet the Candidates Night”. The Annual Meeting will take place beginning at 9:00 A.M. on January 19th , adjourned and followed by voting at 9:30 A.M. with the results to be announced at the 7:30 P.M. Meeting. Eight Candidates are vying for five vacancies on the 2011 Board of Directors. The three Board members elected with the most votes will serve three year terms with the remaining two Directors serving a one year term.

Tomorrow, December16, 2010, the Meeting for 2011 Banyan Springs POA Budget is scheduled for 10: A.M. in the Banyan Room. The Proposed Budget will be reviewed and if approved by the Board will go into effect on January 1, 2011 and be the same as in 2010.

The office will be closed on Thursday, December 23rd at 12:00 Noon and closed on December 24 for the Christmas Holiday. Next week, the office will be closed on Thursday, December 30th at 12:00 Noon and Closed January 31st for New Years!

Barry Prince announced that the purpose of today’s meeting was to inform the residents of the contract breach with Platinum Food Services, Inc. He then turned the meeting over to Robert Dow

Robert Dow reported that the contract calls for a 30 day time frame to get things in order, and to comply with our contract. Christopher LaDagana, D/B/A Platinum Food Services, in the past, would comply with our demands for contract compliance, but the corrections would last for very short periods.

A get-together with Barry Prince, Robert Dow, Rick Leach, Larry Granet and Christopher LaDagana took place on the first of December at which time Christopher LaDagana was advised of many contract breaches, among the complaints filed by our Board were:

· Understaffing

· Cleanliness of the premises

· Food quality

· Food quantity

· Our facility being used for a training ground for Platinum’s employees, and after training, the trainee was taken to another of Platinum’s facilities.

· Untimely payment of rent when due.

Christopher LaDagana responded by admitting that all of the above breaches were true, and that he wanted to continue here as our purveyor of a “Gold Plated Establishment”.

Those persons who were present at that gathering made demands upon Christopher LaDagana if he were to continue running our Poolside Café.

Christopher LaDagana was informed that if he continues, then he must honor the contract and would agree to being present himself for a minimum of 5 days.

Christopher LaDagana was then told that if we gave him 6 weeks from December 1st to clean things up, pay his rent in a timely manner, provide enough help for the comfort of our residents, and, in general bring things back to the way it was when his company first started in our Poolside Patio.

Christopher LaDagana agreed to the terms and was told he was to put it in writing and sign and deliver the Agreement before the end of the next day, which was December 2nd.

Robert Dow went on to state that there were 2 ways to handle the situation, and they were, as told to Christopher LaDagana, and he agreed:

1. We could just change the locks in the Café and supply room, thereby preventing Christopher LaDagana and/or his employees from operating the Café.

OR

2. Give Christopher LaDagana a 30 day notice to fulfill his

obligation to his contract with us.

Robert Dow stated that the latter would be our choice.

The group adjourned with Christopher LaDagana agreeing to our terms. As of this writing we are awaiting to receive the executed agreement and rent payment, as due, from Christopher LaDagana, D/B/A/ Poolside Café.

Barry Prince said there was no need for discussion from the audience as this meeting was called to inform the residents of what has been transpiring between the Board and the Poolside Café.

Larry Granet made a motion to adjourn at 2:00 P.M. Seconded by Paul Whitney and passed unanimously.

Management Update

MANAGEMENT UPDATE

The continuing installation of the water line for Boynton Beach Utilities on Military Trail is moving along. The contractor, Felix & Associates, hopes to be finished with the Military Trail portion of the project in time for the holidays. The Boynton Beach Blvd. , portion of the project will begin shortly thereafter and will proceed west towards the main entrance to Banyan Springs. We have been informed that when the work approaches our entrance, traffic will have to be routed either in the entrance or the exit as two-way traffic. We have been assured that we will be notified by the contractor of the dates that they will be working in front of our entrance, so we can notify our residents prior to that time.

Over the last couple of weeks, many of our residents have had problems with Comcast’s installation of the digital boxes and digital converters. In some cases, the installers failed to show up for their appointments within the scheduled time frame due to problems with earlier installations, some failed to notify the resident that they were going to be late and some of the issues have been technical, due to wiring or signal strength problems. Management has been in touch with our Comcast representative concerning these problems and we have been assured that Comcast technicians are working to overcome some of the technical issues. If you are continuing to have problems, please come be the office and give us your name and address, so we may notify Comcast management to help resolve your problem.

In October, Al Hoffer’s Pest Protection Service was in the community to treat the lawns with a combination of fertilizer, pre-emergent weed and pest control. Certain areas that were treated have developed brown spots. After a supplemental fertilization today, we have been assured that these areas will look better in the next few weeks or they will install new sod.

Last Wednesday, November 10, 2010 , the Proposed 2011 POA Budget, along with the First Notice of Annual Meeting and Election was mailed to all members. The Budget Meeting is scheduled for Thursday, December 16, 2010 at 10:00am in the Banyan Room of the Clubhouse. Candidates Night is Wednesday Night, December 15th and the Election and Annual Meeting is scheduled for Wednesday, January 19, 2011 in the Center.

On November 11th, Frames Tree Service was in the community to remove 7 queen palms that were diseased and needed to be removed immediately. The cost of removal was $1,050.

On Monday, November 15, Charles Baum of CNC Systems, Inc., was here to complete the installation and training on new equipment for Channel 63, which replaced the antiquated system that was failing and is obsolete. The cost of the equipment, setup and training was $3,270. Vera of our office is currently entering all of the information that was on Channel 63 into the new system, which should be done in a few days.

Atlantic Refrigeration was here on Tuesday, November 16th, replacing an original air handler in the ceiling that was beyond repair. The installation was completed earlier today at a cost of $2,588 including tax and installation.

TruGreen Landcare, completed trimming and thinning 50 selected areca palms in the Patio Villas, as part of the ongoing project to keep the areca’s off the roofs of buildings. The cost of the project totaled $2,625 and was funded out of the Landscape Improvements part of the budget.

SPM Inc., completed installation of the kitchen cabinets in the Cabana Club, as part of the continuing improvements to the Cabana Clubhouse. The cost of the cabinets and sink, plus installation totaled $1,425.

Holiday Lighting Inc., is scheduled to turn the holiday lighting at the main entrance on this Friday, November 19th. The lights remain on until January 7, 2011 .

The POA office will be closed next Thursday, November 25th and Friday, November 26th for Thanksgiving. If you have guests coming in for the holiday weekend and need an additional key fob, please stop by the office no later than Wednesday afternoon to rent one for a $50 deposit.
