Old Business

· Barry Prince called upon Robert Dow to report on Comcast. Robert Dow assured all that any problems that arise will be taken care of. He reported that an injunction against Banyan Springs has been made by Terry Whitlock regarding the Comcast contract. He also said that the matter was in legality and could not speak about it publicly

New Business

· Barry Prince said that the Budget for the upcoming year has been presented to the Board for review.

· Joel Brusso made a motion to approve the mailing of the 2011 Budget to residents. Seconded by Robert Dow and passed unanimously.

Architectural Requests

· Two applications were made and approved.

Suggestion Box

None at this time.

Audience Participation

· Eileen Kelner, resident, suggested that we have handicapped bars placed in the non-handicapped booths in the ladies room in the Center. Barry Prince said that he would look into it.

· John Fowler, resident, said that while the road work would be done by the City of Boynton Beach , it may impair entry into our community. Rick Leach said that he would give further study, over and above the thoughts he had on the subject.

· Annette Pomerantz, resident, asked when the road work will be completed on Military near our exit/entryway. Rick Leach said in a few weeks, but the entire project will last about 2 years.

· Terry Whitlock suggested that we have police directing traffic at the entryway on Boynton Beach Blvd. while the road work is being done. Barry Prince said he will check with the Sheriff’s Department to see what they suggest.

· Sy Fish, resident, thanked Barry Prince for the courtesy extended to him to review and discuss the architect’s plan for the renovations to the Fitness Center . Sy Fish said that he, personally, approved the plans and made a few suggestions for improvement of the plans. He went on to say that he is not in favor of the men’s and lady’s room switch.

· Howard Weinberg said that he would like assurance that there would be enough donuts at the next POA General Meeting to go around. Barry Prince assured him that there would be.

· Nelson Kline, resident, asked if the injunction, aforementioned, will affect Comcast keeping appointments with the residents. Robert Dow said the appointments will continue between Comcast and residents as scheduled.

· Richard Rose, resident, asked why 2 of his suggestions had not been replied to. Barry Prince answered by saying that sometimes it is more expedient to answer suggestions on a one-to-one basis, and he will speak with Richard Rose regarding his suggestions.

· Terry Whitlock asked why the Treasurer’s Report could not be put on the Website along with the Minutes. Joel Brusso said that our Website was not a secured Website and that for security reasons the report will not be put on-line.

· Eleanor Zurier, resident, asked who the Defendants and the Plaintiff were in the injunction, aforementioned. Rick Leach answered that the Plaintiff is Terry Whitlock and the Defendants are Banyan Springs Board of Directors, which automatically includes the residents of Banyan Springs, as the Board is elected by the residents and represents the people.

· Terry Whitlock brought up the Comcast contract, at which time Barry Prince said the matter is closed for discussion as it is in legality and cannot be discussed.

Management Update

MANAGEMENT UPDATE

Since the last General Meeting was held back on February 17th, we will bring you up to date on the projects that were completed from the last General Meeting through today.

Back in February, The new sidewalk and stairway to the Rear Sun Deck was completed by JJC Construction. In March, Fine Line Electric installed additional street lights on Hickorywood , Laurelwood and Shadywood Place . In April, Frames Tree Service completed the Annual Tree Trimming Project. In addition, TruGreen Landcare, trimmed and thinned 50 Areca Palms in the Patio Villas that were overgrown or hanging on the roofs.

In May, Fine Line Electric installed two Ceiling Fans and CJ’s Portable Welding, fabricated and installed two stair railings as a safety precaution at the Rear Sun Deck.

In June, Florida Power & Light installed the equipment for their “On Call Program”, which automatically reduced our annual electricity cost by participating in the program by $1600. TruGreen Landcare, cleared vegetation and removed debris around the entrance to the Clubhouse and the Banyan Tree. In late June our staff also installed additional lighting to highlight the Banyan Tree in front of the Clubhouse and we removed the old planters in the Clubhouse in preparation of the tile project

In July, the main project was the removal of the Mexican tile and installation of the new tile flooring by Mario Ferrazoli & Son, which was completed on July 28th. JJC Construction, Inc., removed three concrete knee walls, which were hidden by planters prior to the tile project and Joe Castellano of DBK Industries installed new baseboard after the tile was installed.

In August, Shedquarters, Inc., delivered the 10×14 storage shed to the Cabana Club to provide much needed storage space for tables, chairs and other items when not in use. Later in the month, Pugh Pools & Spa’s, began the project of installing new collector tanks at the Cabana Spa and the Japanese Spa’s, which were completed, inspected and approved by the Palm Beach County Health Department in September. Also, in September, our staff installed new kitchen cabinets for additional storage in the Centers Catering Kitchen and Papico Construction Company completed resurfacing Tennis Courts 2 & 3 on September 23rd.

On October 9th, Price Flooring completed removing the old flooring in the main room of the Cabana Clubhouse and installed new tile at a cost of $4783.73, as part of the ongoing improvements to the Cabana Club. In the meantime, our staff has been involved in painting the Cabana Pool Deck, the interior of the Cabana Clubhouse, walls of the Clubhouse and other areas in the community.

Construction to install the non-potable water line for Boynton Beach Utilities Department which the Board negotiated and Banyan Springs was paid $20,000 for granting a utility easement is well underway. We have not been informed of a completion date, but the area of the easement will be cleaned up and returned to it’s original condition after the project has been completed.

Last week, Holiday Lighting Inc., was in the community to trim the palms and install the lights for the Holiday Lighting at the main entrance. They will return to complete the installation and the lights will be turned on Friday November 19th and remain on until January 7, 2011.

The POA Finance Committee has met on four different occasions over the last few weeks to discuss and formulate a Budget for 2011 to present to the Board of Directors to approve for mailing to the membership. After the mailing is approved and the Budget Meeting Date is set, the Proposed Budget will be mailed to all members along with the First Notice of Annual Meeting and Election Notice. The Election and Annual Meeting is scheduled for Wednesday, January 19, 2011 in accordance with the Association’s Documents.

Representatives from Comcast will be in the Center on October 27th, 28th and 29th from 9:00am until 4:00pm each day to schedule installation of the digital converter boxes, to review any existing higher level plans that you pay for individually and to offer other Comcast services. Further details will be discussed later in this meeting.

In other notes, the 2010 General Election is scheduled for Tuesday, November 2nd, in the Center from 7:00am until 7:00pm and the next POA Board Workshop Meeting is scheduled for Thursday November 4, 2010 at 10:00am in the Banyan Room of the Clubhouse.

Management Update

MANAGEMENT UPDATE

Shedquarters Inc., delivered the storage shed for the Cabana Club on Friday, August 17th as the first part of the improvement projects at the Cabana Club. The 14’ x 10’ shed will provide much needed storage space for tables, chairs and other items when not in use. Our staff is set to begin painting the pool deck today, weather permitting. Other planned improvements will include new flooring in the main area, installation of new cabinets in the kitchen and other items to improve the overall appearance of the Cabana Club.

TEM Systems Inc. replaced two card readers at the main pool gate that were short-circuited due to lightning strikes. Also TEM installed 5 steel gate wheels on the Main Gates at the front entrance of Banyan Springs that were worn out and needed to be replaced.

Al Hoffer’s Pest Protection Services was in the community last week for fertilization of shrubs and weed control as part of our annual contracted services.

The POA received the payment for $20,000 from the City of Boynton Beach for granting a utility easement to install an underground pipe at the corner of Boynton Beach Blvd and Military Trail. Preliminary work has begun on the project and after the project is finished, the area will be restored to its original condition.

Pugh’s Pools & Spa’s has completed the installation of collector tanks at the Cabana Pool and Japanese Hot Tubs in accordance with Palm Beach County Health Department and the State of Florida ’s requirement as part of the Virginia Graeme Baker Act. In addition, Pugh’s Pools & Spa’s applied a non skid surface to the floor of the Japanese Hot Tub area to improve the appearance of the area. The cost of the entire project totaled $40,600 and paid out of the Reserves and the Japanese Spa’s should be open by Saturday after they are chemically balanced and safe to use.

The POA is anticipating receipt of a check from the POA’s Property Insurance in the amount of $2,282.21 for a claim resulting from damage to the gate arm mechanism at the front gate which occurred back in June.

Papico Construction will begin resurfacing Tennis Courts #2 and #3, on Monday, September 20th. The entire project should be completed by Saturday, September 25th, weather permitting, at a cost of $6,550.

A few members of the Board and Management met with representatives of Comcast yesterday to schedule when they will be here to meet with individual residents concerning their cable services and to schedule installation of the digital converters. Comcast will be here on October 27th, 28th and 29th in the Center during the hours of 9:00am until 12:00 and 1:00pm to 4:00pm to schedule installation and to review any existing higher level plans that you pay for individually. Further details will be explained in a letter from Comcast that will be mailed out shortly.

Management will be scheduling a meeting of the Finance Committee in the next two weeks to begin work on the 2011 POA Budget. A preliminary review of all POA expenses at this point appears that there will be little or no increase in maintenance fees for 2011.

· Barry Prince stated that some residents, including yours truly, has not quite understood some of the changes with the new Comcast contract. One of the items in question is the fact that Comcast will not charge for the 3 boxes for digital channels. Any additional channels will have a charge. As stated previously, Comcast will be on site on October 27th, 28th and 29th to answer any of your concerns, and to make an appointment with the residents to install the additional 2 boxes they will supply at no charge.

· Resident, Dick Rose asked about the fact that some of our residents will not be able to attend the sessions with Comcast on those dates. Joel Brusso said that arrangements can be made for those residents to get together with Comcast.

· Resident, Esther Feldman showed concern about landscaping around the new shed at the Satellite pool. Rick Leach said that he would look into it.

· Resident, Jim O’Connell said that he has a D.V.R. and will still have to pay for that over and above the 3 free boxes.

Old Business

· Barry Prince stated that we will not be assessed for the renovations and updating on the Fitness Center . The cost will be $80,000.00-$85,000.00 dollars. It will take approximately 4-6 weeks from start to finish next summer season.

Robert Dow made a motion to accept the bid from Yates & Associates, Architects, to draw up the blueprints for the renovations to the Fitness Center not to exceed a cost of $4,500.00. Seconded by Feige Brody and passed unanimously.

From the Audience

· Audrey Arian announced that the appointment slips for flue shots will be available next Tuesday at the Clubhouse. The hours are 9-11 A.M. She also reminded us that at time of the shots we will need an I.D. and Insurance Cards.

There being no New Business, Architectural or Suggestions, Barry Prince asked for a motion to adjourn.

Management Update

MANAGEMENT UPDATE

Al Hoffer’s Pest Protection Services was in the community July 20th & July 21st for fertilization of the lawns, as per our annual contract.

TEM Systems completed their semi annual inspection and servicing of the gate equipment on Tuesday July 27th, as part of our service agreement with them. The service involves lubrication and adjustments to all mechanical components of the system

The Clubhouse Flooring Project was completed On Wednesday, July 28th and the new baseboards were installed by Joe Castellano of DBK Industries on Thursday, July 29th. The Clubhouse reopened on Friday, July 30th, much to the delight of our residents, many of whom have commented favorably on the new tile floor. The total cost of the Clubhouse Flooring Project totaled $35,125., as additional work was discovered after removal of the Mexican tile, which required installation of fabric membrane to cover cracks in the concrete floor. Installation of the new wood baseboard totaled $1,464 and removal of the two concrete walls and concrete in the Café by JJC Construction cost $3,100. We again, want to thank our residents for their patience and understanding during this major project.

The POA has submitted the executed Utility Easement to the Attorneys for the City of Boynton Beach and are eagerly awaiting the payment of $20,000 from the City of Boynton Beach Utilities Department for the Utility Easement that was approved by the Board on Thursday, July 1st.

Management submitted a claim with the POA insurance for damage to the gate arm mechanism at the Main Gate during the overnight hours of June 20th. The cost of repair was $3,282.21 and we received information that the claim is being processed and we should receive a check for $2,282.21, less the deductible of $1,000.00 from our insurance company. In addition, Management is processing a claim of damages to the insurance company of a driver that damaged a portion of fence and some landscaping near the corner of Military Trail and Cedar Point Blvd. Management will keep the Board informed on both of these matters.

Geoff Pugh of Pugh Pools & Spas has informed us that he has received the approved engineering plans from Palm Beach County Health Department for the installation of collector tanks for the Japanese Hot Tubs and the Cabana Club Spa. The project is scheduled to begin on Monday August 16th on the Japanese Hot Tubs and will progress to the Cabana Spa. The entire project should be completed in approximately two weeks. Closings will be posted around Clubhouse and will be posted on Channel 63.

The Cabinets for the kitchen in the Center that were approved at the last Workshop Meeting have been ordered and will be installed by our staff as soon as they are delivered.

Meanwhile, our staff continues working in the Clubhouse and around the common areas with a number of small projects, such as painting walls, doors or trim and other summertime projects that are easily done while our seasonal residents are away.

· Sheila Goodman, resident, asked Barry Prince to explain what happened at our front gate regarding the damage. He explained that a vehicle smashed through, went on the lawn, and somehow went sideways so that the cameras could not pick up on the license plate.

· Terry Whitlock, resident, asked if we could set the cameras differently to allow for additional pick ups. Robert Dow said that the cameras were set at optimum.

· Anne Nichols, resident, asked if we were planning to retile the floor under the portico at the main entrance. Barry Prince answered by stating that it would cost about $10,000.00 to remove and replace the present tile, and that it was being considered, but no plans have been made.

· Shirley Pomerantz, resident, wanted to know what we were planning to do with the $20,000.00 we receive from the City of Boynton Beach for allowing them an easement. Robert Dow answered by stating that we have no plans, and will not until we receive the funds.

· Barry Prince thanked the Decorating Committee for their great work involving the new floor tiling in the Clubhouse.

Old Business

· Mel Teitzman, Chairman of renovating the Satellite Pool Cabana, announced that the new shed will be arriving next week, and after that the renovations will begin in that Clubhouse. The total cost of the shed will be $2,928.00.

· Esther Feldman, resident, asked how far away the shed would be from the Hot Tub at the Satellite area. Mel Teitzman said that it will be approximately 15 feet from the Hot Tub.

New Business

· Joel Brusso gave a report on the proposed new contract with Comcast. Copy attached. He said that in October Comcast will be coming here to explain about the 3 boxes free of charge, and will make appointments with residents to install them free of charge. We will have 12 months to add more channels at a cost of $8.00 per unit, overall. The basic box will be free. Those who are paying for basic boxes will no longer have to pay.

· Larry Granet spoke and said that in Century Village , of 3,000 residents, Comcast installed the 3 boxes for each resident who wanted them, at no charge, and everyone is happy with the boxes and channels.

· James O’Connell, resident, explained what the new boxes will provide. He also asked if we negotiated the best possible terms with Comcast. Robert Dow answered by stating that, we did negotiate favorably, and we could have had even more channels if we wanted to pay, per unit, an additional $8.00 per month, so the Committee decided against that choice. James O’Connell wanted to know if we could change our minds about channels. Joel Brusso said that we have 12 months of make changes.

· Terry Whitlock wanted to know if we could store some extra boxes for future use, and save money that way. Joel Brusso said that we do not have storage capacity, but that Comcast would come when needed for installations.

· Barry Prince thanked the Committee for their diligence and decisions and called for the motion. The motion was passed unanimously.

From the Audience

· James O’Connell challenged our Rule #4 in the Rule Book regarding posting of notices on our Bulletin Board in the Satellite Pool Cabana. Barry Prince said that a 3×5 card could be used for selling items. Selling or renting apartments, but not for personal messages. The card must be dated and will be removed after 30 days. Jim O’Connell then questioned Article 720. James O’Connell gave his understanding, by the Board of over $200.00 per unit for improvements. Barry Prince said that he would check into it.

· Paul Whitney spoke about the way the Board had been treated. He went on to say that some people have been verbally abusive and that the Board does not deserve that sort of treatment.

· Iris Frater, resident, announced that her villa was burglarized. No person was home at the time, but valuables were taken. She said that she wanted everyone to be aware of strangers in the area, and to keep their doors locked. She also advised us to report any suspicious goings on in our community, or any strangers lurking.

· Anne Nichols asked about the number of cards/fobs each unit receives, and could a check be made as to who uses that card.

· Rick Leach said there is no way we can monitor use of cards or fobs. He explained that each unit gets only 2 cards or fobs. If they have a house guest, they can pay $50.00 deposit for a guest card, voided after 30 days, and when that card is returned the money will be refunded. The guest card is then removed from the system. If a resident loses a card or fob, then they can buy a new one for $25.00, but the lost card I.D.# will be taken out of the system, and not be usable, leaving the resident with only 2 cards or fobs.

· Susan Rund, resident, said that she knows of other communities that have a ruling that aides, cleaning help, etc., but not residents or guests, have a I.D. issued to them for security purposes to be worn around the premises. Barry Prince that it was a good suggestion and that he would look into it.

· Terry Whitlock asked why we do not have perimeter coverage for better security.

· John Fowler announced that he does just that, along with others in golf carts, and that the perimeter is covered periodically.

· Barry Prince once again reminded us that we are a gated community, not a secured community.

· Alan Grossman asked if we could adjust the timer on the gate coming back down after we pass through it, to prevent tailgating. Rick Leach answered by saying that if we change it, the gate will come down too soon and then crash vehicles.

· Jeanne Balsam reported that when a car tailgated her, she followed it to see if it was a resident. Barry Prince said that we should never follow a vehicle, or approach it, but that we should try to get their license plate number and report to 911.

· Terry Whitlock told of a tailgater who he reported and the person was apprehended by police.

Management Update

A Temporary Injunction Hearing filed and held in Palm Beach County District Court on Thursday, July 8th was dismissed due to Banyan Springs Property Owners Association being under Florida Statues 720, Homeowner Associations and not Florida Statutes 718, which covers Condominiums.

On Friday, July 9th, Mario Ferrazolli & Sons began the removal process of the Mexican tile in the Clubhouse. The removal process is now complete and the new porcelain tile is being installed as we speak. Again, we apologize for the inconvenience and will post notices on channel 63 and around the Clubhouse when the Clubhouse reopens.

The Palm Beach County Health Department is currently reviewing the engineering plans for installation of collector tanks for the Japanese Hot Tubs and the Cabana Club Spa. Once the plans are approved, scheduling dates for the project to begin after the Clubhouse Flooring Project has been completed and will be posted on Channel 63, as well as around the Clubhouse.

Some members of the POA Board are looking at various options that Comcast may propose to further enhance or improve the number of channel packages as part of the new technologies and expansion plans of Comcast Cable. These changes could involve having to sign a new contract or an addendum to our current contract, which doesn’t expire until 2015.

Palm Beach County Department of Engineering and Public Works, has received permission from the POA to proceed installing the equipment to install a traffic signal at Cedar Point Blvd and Military Trail. As of this date, Banyan Springs has not been informed of when the county is scheduled to begin or complete the project.

The POA is awaiting the final paperwork and payment of $20,000 from the City of Boynton Beach Utilities Department for the Utility Easement that was negotiated by Vice President, Bob Dow and approved by the Board on Thursday, July 1st.

Management is currently working on a claim with the POA insurance to defray the costs that we incurred at the Main Gate during the overnight hours of June 20th, when the gate arm mechanism was destroyed. The cost of the damage in this incident was $3,282.21, less a $1000 deductible. In addition, Management is continuing to work on two other incidents to recover reimbursement for damages and will keep the Board informed of any progress towards settling these matters.

Larry Granet made a motion to accept the Treasurer’s Report. Seconded by Mel Teitzman and passed unanimously.

· Barry Prince made a motion to appoint John Fowler as Sergeant at Arms. Seconded by Robert Dow and passed unanimously.

Management/President’s Update – Rick Leach read the Management Report – Copy attached.

· Rick Leach announced that a Temporary Injunction hearing filed and held in Palm Beach County District Court on Thursday, July 8, 2010 was dismissed due to Banyan Springs Property Owners’ Association being under Florida Statutes #720, Home Owners Association, and not Florida Statutes #718, which covers Condominiums.

· Rick Leach also announced that a traffic signal will be installed at the intersection of Military Trail and our rear entrance. A date has not been set yet.

Discussion following Rick Leach’s report:

· James O’Connell, resident of Condo #1, asked if, because we are a noteworthy customer of Comcast, will be getting some extras over and above what they offered to us. Barry Prince replied in the affirmative, stating that we will be getting additional channels, boxes, etc.

· Terry Whitlock, resident of Terrace Homes #2, basically challenged the court’s upholding of Statute #720 pertaining to Banyan Springs, and feels that he will challenge it again in court. Barry Prince replied if we have to go to court again, we will go.

· Shirley Pomerantz, resident of Condo #4, wanted to know how much the Board can spend without authorization. Rick Leach replied by saying that the Board can spend up to $200.00, per unit, plus cost of living index. This amount was declared several years ago, so the amount has risen.

· Susan Rund, resident of Condo #6, announced that we have a certified copy from the Secretary of State that we are governed under Statute #720.

· James O’Connell, resident of Condo #1, asked how much the Board is allowed to spend without a vote of approval from the home owners under Statute #720. He stated it was 10% of the annual budget. Barry Prince said that he would look into it and get back to Mr. O’Connell.

· Jeanne Balsam, resident of Terrace Homes #1, stated that she felt her E-Mail address was used for matters that disturbed her. Barry Prince answered that this was not part of this discussion and would she bring it up after the meeting, as her E-Mail was for public use as it was printed in our community address book.

Old Business

· Robert Dow announced that the Board will modify the amount of monies charged for requests for copies and viewing of records. This applies to the Florida Law stating that requests of this sort are to be in writing, sent to the Board by certified mail with return receipt requested.

· Rick Leach then said that due to several requests from Terry Whitlock, for example, that over 12 hours were spent looking back through old files, which have to be kept for 7 years.

· Robert Dow then asked Joel Brusso if he would modify his motion to change $25.00 per hour from persons checking and making copies for past meetings to $20.00 per hour. Joel Brusso agreed. A discussion followed: Terry Whitlock challenged Rick Leach’s statement. James O’Connell wanted to know how many other requests for old records had there been last month. Rick Leach replied, one. Barry Prince stated that requests for records and/or copies that take less than 15 minutes would not have a charge. Barry Prince called the motion and it was passed unanimously.

New Business

· Robert Dow announced that it was, according to our Rules and Regulations, illegal to post any written material on our Bulletin Boards, with some exceptions. He then held up and showed the audience a notice that was posted on the tennis courts Bulletin Board that was unauthorized. Copy attached. He went on to say according to Article 4b in our Rules book, a person or persons violating our Rules, whose violation is reported to our Violations Committee, can be fined. He stated that the posting of this sign was viewed by 2 witnesses.

· Joel Brusso spoke of our need to replace wire shelving in the kitchen in the Center with cabinets. He said that the least expensive and suitable cabinets presented were from the Accent Building Products Company in the amount of $1,312.55, including delivery. He said that our own people would install them. A few questions were asked regarding the cabinets, which were answered to the persons’ satisfaction.

· Harry Sassower made a motion to accept the proposal from Accent Building Products Company in the amount of $1,312.55 for Kitchen Cabinets in the Center. Seconded by Larry Granet and passed unanimously.

From the Audience

· Barbara Flaxman, resident of Condo #9, asked Mel Teitzman if a storage area was made available for easels, etc., he answered in the affirmative.

· David Lefton thanked the Board for using the public address system at the meeting today.

· Helen Tasch, resident of Condo #7, asked if persons who are not owners may ask questions at the meetings. Barry Prince said that they can.

· James O’Connell, resident of Condo #1, suggested that our meetings Agendas be posted on Channel #63, as well as the Minutes. Rick Leach replied with information that the Meeting Minutes of the previous meeting and Agenda are posted on our Website. Barry Prince said that he thought it was a good idea to post the forthcoming Meetings Agendas on Channel 63.

· A resident stated that she could not find the Minutes of the Budget Meeting. Rick Leach said that he could not find them on the Website either, but that she was welcome to go into the office and request a copy of those minutes.

· Faye Simensky, resident of Clearbrook, suggested that someone bring a mike to the folks who want to speak so that all can hear them. She also asked about the Satellite Pool Cabana flooring, which Barry Prince said he will show her after the meeting.

· Marty Joselle, resident of Condo #7, spoke about not wanting to attend a meeting and listen to 2 people who dominated the meeting.

· James O’Connell, resident of Condo #2, spoke and defended his actions of today.

· Terry Whitlock, resident of Terrace Homes #2, stated that in his opinion a secured website should be established so that persons with a code would have access to all records, and there would not be a need to have to pay to review these records.

· Barry Prince went on to state that Chris La Dagana, our café proprietor, has reduced the price of the large drinks back to $1.00 with a 50 cent charge for seconds, and also reduced the price of the small salads.

· Barry Prince then gave the President’s Update, copy attached, which was, in part, emotional and well received by the audience. One of the highlights of his report was the fact about the injunction that was submitted by 3 residents, not all homeowners. He also commended the Board for their work and position during this time.

Management Update

THURSDAY, JULY 1, 2010

TruGreen Landcare, cleared vegetation and debris around the Banyan Tree in front of the Clubhouse, as well as thinned out areas on both sides of entrance to the Clubhouse as part of Landscaping Improvements to the common areas. The cost of this additional project was $2000 and was completed on June 3rd. In addition, our staff installed lights to illuminate the Banyan Tree, which is the icon of our community.

Over the last two weeks, the staff began dismantling the planters, removing baseboard and making other preparations prior to the start of the Clubhouse Flooring Project. On Thursday July 8th, the Clubhouse will close at 2:00pm , as workers begin putting up plastic sheeting and our staff makes final preparations for the project, which begins with the removal of the Mexican Tile on Friday, July 9th. Because of the air conditioning having to be shut down, the majority of the Clubhouse will be closed during this time including the Café and the Office will be closed on Friday and reopen on Monday, July 12th. As soon as the old tile is removed and the new tile is laid and grouted, portions of the Clubhouse will be reopened as the job progresses. The Pool, Fitness Center Building , the Center and the Banyan Room will remain open throughout the project for card playing and other activities. We apologize in advance for the inconvenience and will post notices on channel 63 and around the Clubhouse to keep our residents informed.

Pugh Pools, Inc. is awaiting approval of the engineering plans for installation of collector tanks for the Japanese Hot Tubs and the Cabana Club Spa. Once the Palm Beach County Health Department approves the plans, Management will be meeting with Geoff Pugh to schedule dates for the project to begin after the Clubhouse Flooring Project has been completed.

On June 7th, the contractor for Florida Power & Light was here to install the equipment at the Clubhouse and Cabana Club in order to participate in FPL’s “On Call Program”. The program will automatically save the POA $1,680.00 per year or $140.00 per month on our electric bill.

Banyan Springs now has a new Bookkeeper, Mary Annalori. We welcome Mary to the Banyan Springs family and look forward to working with her.

Alice Cohen, our representative from Comcast Cable, met with executive members of the POA Board on Tuesday, June 15th to discuss future plans of Comcast, concerning changes and realignment of channels, as well as expanding digital channels. We are currently under existing contract with Comcast until 2015.

On June 14th, the Property owners Association received a letter from Palm Beach County Department of Engineering and Public Works, requesting permission to proceed with the installation of equipment to install a traffic signal at Cedar Point Blvd and Military Trail. A signal at this location has been needed for quite some time as there have been a number of accidents over the years, so we are thankful that County Commission Chairman, Burt Aaronson apparently has moved the project forward. No timetable has been given to us as to when the signal will be completed at this time.

Members of the Board met on Tuesday, June 16th with Garth Rosencranz and Jasmin Wood of Lamn, Krielow, Dytrych & Company to discuss the final draft of the 2009 Financial Statement. At today’s Meeting, the Board will consider approval of the Final Draft and if approved, copies of the Financial Statement will be available to all interested Unit Owners at the office after today’s meeting.

An incident occurred at the Main Gate during the overnight hours of June 20th, in which a suspected intoxicated driver drove into the gate arm mechanism, damaging it beyond repair. Unfortunately, a rare malfunction of the security system camera system prevented us from capturing the event, although we may not have been able to capture the license plate. Fortunately, insurance will cover the cost except for the deductible of $1000.

On Monday, June 28th, Al Hoffers Pest Protection Services, was in the community to treat the grounds for pests, as per their contract with Banyan Springs.

Late Monday afternoon, a driver on a cell phone had an accident on Cedar Point Blvd. coming off of Military Trail. The incident caused damage to the fence behind Terrace Homes 3 and also some shrubs. Fortunately, Vice President Bob Dow drove by the incident, stopped and called the authorities, so we will be able to make a claim against the drivers insurance to pay for the damages.

The office will be closed on Monday, July 5th in observance of the 4th of July Holiday and the office will also be closed on Friday, July 9th for the beginning of the Flooring Project.

Harry Sassower made a motion to accept the Minutes of the May 27, 2010 Workshop Meeting as corrected. Seconded by Larry Granet and passed unanimously.

Treasurer’s Report – Joel Brusso

Joel Brusso gave the Treasurer’s Report and informed all that the Annual Financial Statement was completed and was available for pickup at the office.

Larry Granet made a motion to accept the Treasurer’s Report. Seconded by Mimi Plonsky and passed unanimously.

Resident Howard Weinberg asked if the insurance company paid for the damages occurred at Lakeside Condo #9 to the bushes and knocked down tree. Joel Brusso assured him that the bill for $590.37 had been paid by the driver’s insurance.

· Rick Leach announced that while the tiling was being installed in the Main Clubhouse, the entrance to the office would be through the door to the Art Room . All other areas are to be accessed through the Pool Gate, which is the Banyan Room, Fitness Center , Main Pool, Beauty Salon, etc. The tiling of the floor will take approximately 1 week to 12 days.

New Business

· Mel Teitzman, Chairperson for the makeover of the Satellite Pool building announced that the price received from the contractor was $11,830.00 which includes a 10X14 Storage Shed, which will be well hidden from street view and an offensive site.

· Sheila Goodman, Decorating Committee Chairperson, showed the Board the Committee’s choice of flooring and wall paint. The price also includes cabinets and countertops for the kitchenette. The old cabinets and sinks in the restrooms will be replaced with “hung” sinks.

· Barbara Flaxman, resident, suggested that something be done about the small storage area. Barry Prince replied that he will look into it.

· David Lefton, resident, spoke about some water seepage into the main room. Barry Prince said that he will check it out.

Cedar Point Easement – Copy attached.

· Robert Dow spoke of and presented a proposal from the City of Boynton Beach regarding the Cedar Point Utility Easement on the corner of Boynton Beach Blvd. and Military Trail. He had been negotiating with the City for 2 years, and finally they agreed to pay us $20,000.00 for the easement they need.

· Robert Dow made a motion to accept the offer of $20,000.00 from the City of Boynton Beach and grant the City an easement as proposed. Seconded by Harry Sassower and passed unanimously.

· Barry Prince then applauded Robert Dow for his tedious work on the project, as did the audience.

· Robert Dow then spoke of his and his wife’s presence at the rear entrance where an accident occurred and caused damage to our property. He called the Sheriff’s office and they attended to the matter. He said that he mentioned it only to remind residents that they, too, should report any accident or damages to our property to the officials.

· Robert Dow then mentioned that a truck had tailgated another vehicle into our property. He also reported that to the Sheriff.

New Business

· Joel Brusso told us of one of the new Statutes in Florida Law.

· “If a homeowner/resident wants to review any of past records they must submit a request on the proper form and mail it registered, return receipt requested, to the office. The office may charge a reasonable fee for looking into, copying, etc. all of which takes time. The Banyan Springs Board wishes to charge a fee of $25.00 per hour for such efforts.”

· Considerable objections from the floor were noted. After several residents spoke of the Statute and charges. Barry Prince tabled the matter of a charge until further notice.
